My questions are: Is that fair? How can the author(s) protect the solution against any unauthorized use?

I think the chances of any kind of protection are pretty bad. It would not be the first time that other people earn money with foreign, intellectual performance.  It would also not be impossible that some copycats appear on the scene, who claim they have also found this solution, independent of the real author(s).
